Applicability

The general conditions of sale apply to all offers by, orders at, deliveries by and payments to Bakkerij van Heeswijk VOF., These conditions can only be deviated from if this is done in advance, in writing and explicitly on points, with the other provisions remaining in full force. By accepting an offer or placing an order, the customer of Bakkerij van Heeswijk indicates acceptance of these conditions. Offers and prices Offers by and prices of Bakkerij van Heeswijk are without obligation. Bakkerij van Heeswijk accepts no liability for misprints or printing errors. Bakkerij van Heeswijk reserves the right to immediately pass on changes in cost prices, exchange rates or (legal) regulations. All applicable prices are always inclusive of VAT and exclusive of order and shipping costs, any taxes or other levies, unless otherwise stated or agreed in writing.

Orders

By placing an order by phone, post, fax, E-mail, Internet the agreement is a fact. Bakkerij van Heeswijk reserves the right to refuse orders without giving reasons, or to attach conditions to them, such as requesting an advance payment. Deliveries Bakkerij van Heeswijk will always strive for prompt delivery of the ordered goods. However, stated delivery times are indicative only. Exceeding any delivery period does not entitle the customer to compensation or the right to dissolve the agreement referred to in article 3. All rights and claims, as stipulated in these conditions, also apply to third parties engaged by Bakkerij van Heeswijk for the delivery. The Customer is obliged to examine upon delivery whether the products comply with the agreement. If this is not the case, the customer must inform Bakkerij van Heeswijk as soon as possible, but in any event within five (5) days of delivery, in writing and stating reasons. Payment The customer fulfils the obligation, arising from the agreement referred to under point orders, at Bakkerij van Heeswijk, iDeal (internet payment).

Complaints, warranty and returns

The period for complaints regarding delivered goods is limited to the provisions under point deliveries, 3rd paragraph. If it is proven that the products do not comply with the agreement, Bakkerij van Heeswijk shall have the choice of replacing the products in question with new products upon their return or refunding the invoice value thereof. The warranty period for delivered products is the period guaranteed by Bakkerij van Heeswijk's relevant supplier, counting from the date of delivery by Bakkerij van Heeswijk Within this period, defective parts will be replaced or repaired free of charge, subject to the supplier's specific conditions. Return shipments will in all cases only be accepted if they have been notified to Bakkerij van Heeswijk in advance, if they have a unique return number and if the product's packaging is undamaged. The costs of return shipments shall be borne by Bakkerij van Heeswijk in the case of the items referred to under Complaints, warranty and return goods, 1st and 2nd paragraphs, and in all other cases by the customer. Transfer of risk and ownership The risk of the delivered goods passes from Bakkerij van Heeswijk to the customer as soon as delivery has taken place. However, ownership shall not be transferred until the customer has fulfilled all his obligations referred to under payment, 1st paragraph.

Customer details

If the Customer provides Bakkerij van Heeswijk with an address, Bakkerij van Heeswijk shall be entitled to send all orders to that address while retaining all rights referred to in point payment. Customers are obliged to notify changes of address in writing to Bakkerij van Heeswijk Dorpstraat 58 5575 AE Luyksgestel

Liability

Bakkerij van Heeswijk is not liable for any damage, which cannot be attributed to intent or gross negligence on the part of Bakkerij van Heeswijk or which has arisen as a result of circumstances beyond the control of Bakkerij van Heeswijk. Bakkerij van Heeswijk bears no responsibility for information, photos, leaflets and other forms of information materials as far as issued under the responsibility of third parties. Bakkerij van Heeswijk also bears no responsibility for actions and/or shortcomings of third parties. Bakkerij van Heeswijk is not liable for misunderstandings, delays or improper transmission of orders and notifications as a result of the use of internet or any other means of communication in the traffic between the client and Bakkerij van Heeswijk , unless and insofar as there may be intent or gross negligence on the part of Bakkerij van Heeswijk . Liability for damages against which the client is already insured is excluded at all times by Bakkerij van Heeswijk.

Complaints

The Customer is obliged to inspect the goods immediately after delivery. Under penalty of forfeiture of all rights, complaints must be submitted to Bakkerij van Heeswijk in writing - or by email - within one day of the time of delivery of goods, specifying the nature of the complaints in respect of the goods delivered. However, defects and defects visible on delivery must be reported to Bakkerij van Heeswijk within 6 hours of delivery, on pain of forfeiture of all rights arising therefrom.
